Terms and conditions for digital image licenses.

1. Seller and scope

These terms apply to new purchases of digital image files and licences and printed calendars in the shop. Individual agreements take precedence. Existing contracts are not retrospectively changed.

2. Ordering and conclusion

Product displays invite orders. You can change items and quantities in the cart and review your details, payment method and total including shipping at checkout. “Order with obligation to pay” submits a binding offer. The contract is concluded when it is accepted in the emailed order confirmation. Your order and applicable conditions are supplied in a form you can save. Orders can be placed in German or English. An account is optional.

3. Prices and payment

Prices are final. No VAT is charged under the German small-business exemption, section 19 UStG. The payment methods offered at checkout are PayPal and advance bank transfer. Bank details and the order reference are supplied in the confirmation. The full total is displayed before ordering.

4. Digital images and delivery

The original files described on the product page and selected usage rights are supplied. The product page states the format, known resolution and actual download limits. PayPal downloads are provided after successful payment; bank-transfer downloads after receipt of payment. Early digital provision requires your express consent, acknowledgement of loss of withdrawal rights and the required contract confirmation. Access is emailed and, where applicable, available in your account. Save files locally within the stated period and contact me with the order reference if problems occur.

5. Digital image licences

After full payment you receive a non-exclusive licence, worldwide, for ten years from purchase. Editing, including cropping and colour changes, is allowed without distorting or degrading the motif. Attribution is not required and copyright remains with S.E.B. Fotografie. Basic is exclusively non-commercial. Advertising, marketing, business websites, commercial publishers and client projects require Commercial. Image products for resale, including posters, postcards and calendars, need a separate agreement. For the agreed client project, the file may be passed to the client and production providers, such as printers or designers. The client may use the project output within the purchased commercial licence; providers may process the file only for that project. Independent sublicensing, reuse in other projects, stock resale, freely downloadable files and extractable templates are prohibited. There is no credited licence upgrade; the other licence is purchased again. See the licence information. A licence does not replace permissions required for identifiable people, trademarks or artworks.

6. Printed calendars

Calendars are physical goods and do not include digital downloads or reproduction rights. The product description states the actual year, specifications, price and availability. Regular shipping is within Germany only, €7.99 per order, delivery in three to four days after receipt of payment. Delivery abroad requires an individual offer before ordering. The seller named in section 1 is the manufacturer of S.E.B. Fotografie branded calendars and the contact for complaints and returns.

7. Statutory guarantee rights and complaints

Statutory guarantee rights apply to digital content and goods. For defective calendars consumers have a statutory guarantee period of at least two years; the official EU notice is displayed with the goods offer. Report technical problems, damage or incorrect deliveries with your order reference to soeren@sebfoto.de. Statutory rights do not require a voluntary additional guarantee.

8. Withdrawal

Consumers receive the withdrawal instructions for digital content and goods including a model form. The exception for early digital provision does not apply to printed calendars or automatically to the physical part of a mixed order. The withdrawal function is available through “Withdraw contract” in the footer; post and email remain available.

9. Liability

Liability is unlimited for intent, gross negligence and injury to life, body or health. For slight negligence in essential contractual obligations, liability is limited to typical foreseeable loss. Mandatory statutory liability remains unaffected.

10. Law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain mandatory protections of their habitual-residence country. Statutory jurisdictions apply. S.E.B. Fotografie neither participates in nor is obliged to participate in consumer arbitration proceedings.
