Terms and Conditions (Photobooth) – Courtesy Translation

This is a complete courtesy translation of the German photobooth terms. The German version is legally binding.

1. Scope

These terms apply to photobooth rental and provision by S.E.B. Fotografie and related services, including setup and dismantling, props, online gallery and downloads, unless otherwise agreed in writing.

3. Services

Unless the order confirmation states otherwise, services include:

• Setup and dismantling of the photobooth
• Props
• Travel within a radius of 12 km from Neustadt-Glewe; other distances by agreement
• An online gallery and downloads of the photographs taken

The order confirmation specifies the type, location, time and scope of the services.

4. Booking and conclusion of the contract

An enquiry is non-binding. After your enquiry you receive an offer; acceptance usually takes place by email. The contract and binding reservation are concluded only when both contracting parties have signed the contract. The time of the second signature determines conclusion of the contract.

Changes and additions take effect only when confirmed in writing.

5. Customer cooperation

• Provide a level, dry and solid site of approximately 2 × 2.5 metres or more, with a suitable power supply, normally a 230V/16A Schuko socket.
• Provide suitable access to the venue and any necessary parking or access permissions.
• Inform guests and participants that a photobooth will be used and photographs may be taken.

The customer is responsible for protecting the photobooth against damage, moisture, theft and improper use.

6. Price and payment

Payment is available by PayPal or bank transfer. Unless individually agreed otherwise, the invoice amount is payable within 14 days after the invoice date. No deposit or advance payment is required unless agreed for the individual booking.

7. Cancellation and contractual withdrawal

You may cancel the contract. The following cancellation charges apply to the rental price:

• Cancellation up to four weeks before the rental starts: 25%
• Cancellation up to two weeks before the rental starts: 50%
• Cancellation up to three days before the rental starts: 90%
• Cancellation less than three days before the rental starts: 100%

The time at which we receive your cancellation, for example by email, is decisive. You may prove that no loss or a substantially lower loss occurred.

8. Disruption and force majeure

If force majeure or circumstances outside our responsibility, such as an accident or a power failure at the venue, prevent all or part of the service, we will seek an appropriate solution, such as another date or a replacement device. Further claims remain subject to the statutory rules on liability.

9. Liability

Liability is unlimited for intent, gross negligence and injury to life, body or health. For ordinary negligence, liability applies only to breaches of essential contractual obligations and is limited to foreseeable loss typical of the contract.

10. Rights to photographs and online gallery

Copyright in the digital photographs remains with S.E.B. Fotografie. After full payment, the customer receives a non-exclusive right to use the photographs privately and to provide them to guests and participants, for example by download or sharing. Commercial use, such as advertising, requires a separate agreement.

S.E.B. Fotografie publishes photographs for marketing only after separate consent, such as a model release, or express approval.

11. Data protection

12. Final provisions

German law applies. If the customer is an entrepreneur, the place of jurisdiction is Neustadt-Glewe.
