Withdrawal for the dated photobooth package for private celebrations

The agreed package provides a photobooth for a specific event date, including delivery, setup, collection and the agreed additional services. Guests operate the photobooth themselves during the event. Consumer contracts for this package for a wedding or another private celebration carry no statutory withdrawal right under section 312g(2)(9) BGB because they concern a service related to a leisure activity on a specific date.

These bookings carry the additional free cancellation right in the photobooth terms: 14 calendar days after conclusion if the event date is at least 42 calendar days after the contract date. The second signature determines conclusion.

Other contracts and business customers

A contract concluded predominantly for commercial or self-employed professional purposes carries no consumer withdrawal right. The purpose of the actual contract determines this, rather than the event label or a company address alone. For consumer distance or off-premises contracts outside the statutory exception above, the following instructions apply.

Instructions where a statutory withdrawal right applies

You may withdraw from this contract within fourteen days without giving a reason. The period is fourteen days from conclusion. The contract and reservation become binding with the second signature; the period does not begin before proper withdrawal information has been supplied. Effects of statutory withdrawal

We reimburse payments without undue delay and within fourteen days of receiving withdrawal, using the original payment method unless expressly agreed otherwise, without reimbursement fees. If you expressly requested services to begin during the withdrawal period, you must pay an appropriate amount for services supplied up to withdrawal in proportion to the full agreed scope where the statutory requirements are met. Booking or signature alone does not end withdrawal rights for services; early expiry requires full performance and the statutory conditions, including prior express consent to starting and acknowledgement that the right ends upon full performance. Delivery or setup alone does not fully perform the entire contract, including agreed ongoing gallery access. The declarations are collected separately and optionally; without them, an early start requires separate clarification.

Contractual cancellation

The schedule is set out in the photobooth terms and the supplied contract version. Receipt of your declaration determines the applicable period. An additional free cancellation period of 14 calendar days after conclusion applies if the event date is at least 42 calendar days after the contract date. Otherwise, only concretely proven loss recoverable under applicable law, less saved costs and replacement bookings, may be claimed. Statutory rights remain unaffected.
