Terms Photobooth
Terms and conditions for photobooth rental.
Terms and Conditions (Photobooth) – Courtesy Translation
Updated: 5 October 2026
This is a complete courtesy translation of the German photobooth terms. The German version is legally binding.
1. Scope
These terms apply to photobooth rental and provision by S.E.B. Fotografie and related services, including setup and dismantling, props, online gallery and downloads, subject to individual agreements, which take precedence.
2. Provider and contracting party
Sören Eberhardt-Biermann, trading as S.E.B. Fotografie
Schweriner Str. 15
19306 Neustadt-Glewe
Germany
Telephone: 0173 / 926 6802
Email: soeren@sebfoto.de
3. Services
The offer and signed contract determine the package, venue, event date, rental period, price and additional services. Delivery, setup, collection and props are included unless agreed otherwise. Guests operate the photobooth themselves during the event; continuous attendance by an operator is not included.
The first 12 km of one-way travel from Neustadt-Glewe are free. Additional travel is charged at €1.20 per additional kilometre of one-way distance and stated in the offer. Printing and AI options are included only if agreed.
All photographs in the live gallery can be handed over or transferred. The photobooth gallery is available for six months and is then deleted. Gallery access is separate from public publication.
4. Booking and conclusion of the contract
An enquiry or waiting-list entry is non-binding. Acceptance of the offer usually takes place by email. The contract and reservation become binding only when both contracting parties have signed; the time of the second signature determines conclusion.
Changes should be recorded in text form, for example by email, for documentation. Individual agreements retain priority.
5. Customer cooperation
You provide a level, dry, secure site of approximately 2 × 2.5 m, a suitable power connection (normally 230 V/16 A Schuko), access, and any necessary parking or venue permissions. Inform participants about photographs and gallery access.
Handle the photobooth with care and protect it against damage, moisture, theft and misuse. Liability follows the applicable legal requirements; damage alone does not create liability without fault.
6. Price and payment
Payment is available by PayPal or bank transfer. Unless individually agreed otherwise, the invoice amount is payable within 14 days after the invoice date. No deposit or advance payment is required unless agreed for the individual booking.
7. Cancellation and additional free cancellation period
You may cancel the contract by an unequivocal declaration, for example by email to soeren@sebfoto.de. In addition to statutory rights, cancellation is free within 14 calendar days after conclusion if the event date is at least 42 calendar days after the contract date. The contract is concluded with the second signature. The cancellation period begins the following day and ends at the end of the 14th calendar day. Your declaration must reach us within that period. Calendar dates are determined in Europe/Berlin local time.
There is no additional free cancellation period if the event is closer or the period has expired. We charge no percentage-based cancellation fees. Any claim is limited to concretely proven loss recoverable under applicable law, reduced by saved expenses and income from replacement bookings. You may show that no loss or a smaller loss occurred. Payments and reimbursements are settled after reviewing the actual claims.
Statutory withdrawal, termination and other statutory rights remain unaffected. Statutory withdrawal is not subject to the 42-day condition and incurs no contractual cancellation charge. Its statutory deadlines and reimbursement rules apply separately.
8. Disruption of services
For failures or other service disruptions, we seek an appropriate solution such as replacement equipment or an agreed alternative date. Statutory rights to a price reduction, termination, reimbursement or damages remain available subject to their respective requirements. An alternative date requires both parties’ agreement.
9. Liability
Liability is unlimited for intent, gross negligence and injury to life, body or health. For ordinary negligence, liability applies only to breaches of essential contractual obligations and is limited to foreseeable loss typical of the contract.
10. Rights to photographs and gallery access
Owning and operating the photobooth does not automatically create copyright in every photograph triggered by a guest. Actual rights determine what can be licensed. To the extent we hold the relevant rights, after full payment we grant a non-exclusive right for the agreed event purpose: private use and sharing with participants, and internal use and sharing for corporate events. External advertising or other commercial exploitation requires a separate agreement.
Third-party copyright and the rights of people pictured remain unaffected. Website, social-media or advertising use by S.E.B. Fotografie requires separate permission from the people concerned. Booking does not replace that permission.
11. Data protection
The photobooth privacy notice explains processing for the photobooth service, particularly the online gallery and communication. See Photobooth privacy.
12. Final provisions
German law applies. Mandatory consumer protection remains unaffected. Statutory rules determine jurisdiction.
